There is an inherent potential risk in outdoor activities due to their very nature. The person contracting such activities must be aware of this. The instructors and technicians have the training and experience appropriate to the activities they deliver. Safety during the activity depends to a large extent on following their instructions and guidelines. You are responsible for your own actions and decisions.

GENERAL

Activities are subject to sea conditions and to the condition of participants, both of which may change significantly during the activity (weather, worsening sea state, fatigue, etc.). Schedules, itineraries, and activities may be modified or even suspended if circumstances so advise, always at the discretion of the person in charge at MATER Museoa.

The client is obliged to inform us of any possible pregnancy, injuries, or other conditions that could endanger their health, personally assuming any potential harm that undertaking the contracted activity could cause in such cases. The client also undertakes not to be under the influence of alcohol, drugs, or any other medication that could affect their reaction time and reflexes. Should this be the case and, after assessing the situation, access to the activity may be refused without the right to a refund of the total amount of the activity.

The client agrees to follow the explanations and orders given by the instructors and not to question their authority or professionalism. MATER Museoa declines all responsibility for any accident caused by recklessness, negligence, or rash behavior by any participant who fails to follow the instructor’s guidelines and instructions during the activities.

Minors must be accompanied by their legal guardian or a responsible adult; otherwise, they must have a signed authorization from their legal guardian.

MATER Museoa’s commitment begins with the contracted activity; therefore, the client is responsible for their transportation to our facilities or to the starting point of the activity (unless otherwise indicated) at the agreed time. We can accept a delay of up to 15 minutes; beyond that, the duration of the activity will be reduced while the full price will still be charged. The contract and responsibility of MATER Museoa relate exclusively to the direct work of its instructors and the organization of the activity; MATER Museoa is in no way responsible for external services that are contracted and paid directly by the client.

MATER Museoa is not responsible for the loss of or damage to clients’ personal belongings.

The participant consents to the use of images taken during the activities for informational campaigns that MATER Museoa may undertake in the future and as examples for subsequent participants who carry out activities with the company.

INSURANCE

MATER Museoa has the corresponding liability insurance and accident insurance. Full information on the terms and coverage of the insurance policies is available to clients.

PERSONAL DATA PROCESSING

  1. Personal data are obtained to form part of files for which MATER Museoa is responsible, as the sole recipient of the information voluntarily provided by you.
  2. These files are used for the administrative, accounting, and logistics management of the entity’s clients, which cannot be carried out without personal data.
  3. Rights of access, rectification, erasure, and objection may be exercised by email to itsasgela@itsasgela.org.

PRICES

  1. The prices for each activity are shown on the technical sheets found on the website together with the description of the activity.
  2. Prices are always per person and include the services indicated by MATER Museoa in each technical sheet, as well as VAT.
  3. Unless otherwise indicated, all services and expenses incurred and their contracting (transport reservations, accommodation, meals, etc.) are borne by the client, although MATER Museoa can assist with their arrangements.

BOOKING THE ACTIVITY AND CANCELLATION POLICY

To book the activity, you must make a minimum payment of 30% of the total quoted price, in cash or by bank transfer, sending the transfer order to info@matermuseoa.com; a booking will not be considered valid until this payment has cleared, and MATER Museoa is fully entitled to sell the place(s) until then.

All activities offered on a specific date in our schedule are subject to a minimum group size in order to run. Therefore, the client will be notified by email or phone at least 48 hours in advance if the departure is confirmed. It is the client’s responsibility to monitor these channels to be correctly informed. If the minimum is not reached, the activity may be canceled and the amount paid will be refunded, with no right to any compensation.

The remaining balance is payable on the same day as the activity, in cash or by bank transfer upon receipt of the invoice.

Any activity may be canceled, modified, or postponed up to 48 hours before it begins—or even immediately prior to its start—if, in MATER Museoa’s judgment, terrain or weather conditions are not suitable. In such cases, the client is entitled to change dates or receive a full refund of the amount paid, but not to any compensation.

Any modification or suspension of the activity once it has started due to causes beyond the organization’s control will not entail any refund, replacement of the activity, or compensation.

Any safety-related decision taken by the instructor during the activity must be respected by the client; otherwise, the instructor may cancel the activity without any right to a refund.

Cancellation fees:

  1. Up to 15 days before the activity, or in duly justified force majeure, no cancellation fees will be charged. The total amount paid as a deposit will be refunded at the request of the interested party, regardless of the reasons.
  2. After this period, the deposit (30% of the total) is non-refundable. For this reason, it is recommended that users take out external insurance (at their own expense) to cover unforeseen contingencies beyond their control (illness, official summons, etc.).
  3. At any time up to 1 week before the activity, you may request, free of charge, to switch to another scheduled date shown on our pages, subject to availability, paying or receiving any difference in the price of the new date.
  4. If you cannot or do not wish to take part in the activity for any reason, up until the start time you may designate another person to take your place under the same conditions and obligations, with no additional charge.
  5. For any communication regarding a change of activity or cancellation, it is sufficient to send an email (the original text omits the address), requesting an acknowledgment of receipt, indicating whether it is a cancellation or a change and the new requested date. Please provide a telephone number so we can contact you.

From the confirmation of the booking, the client accepts these General Conditions in their entirety, which shall also serve as the CONTRACT.
